Form I-130 is the first step in sponsoring a family member for US permanent residence (a green card). A US citizen or lawful permanent resident files it to establish the qualifying family relationship with USCIS.
For immediate relatives of US citizens (spouse, parent, or unmarried child under 21), there is no annual visa cap and no waiting period after approval. For all other family categories, a visa number must become available based on the preference system, which can take years.
After I-130 approval and visa availability, the beneficiary either applies for an immigrant visa abroad (consular processing) or adjusts status inside the US using Form I-485.
